Patna High Court

Chandrajit Bind @ Karelu Bind @ Karailu BindversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Chandrajit Bind was arrested in connection with a case registered under Section 304(b) of the Indian Penal Code for the alleged killing of a deceased person, although the FIR indicated the death might have been a suicide. The petitioner, who has been in custody since 20 June 2025 and has a clean antecedent, applied for regular bail, asserting his innocence. The State opposed the bail application. The court considered the clean antecedent, the period of custody, and the circumstances suggesting possible suicide, and consequently granted regular bail. The petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties of the same amount, and the court clarified that its observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether regular bail should be granted in a case under Section 304(b) where the death may be a suicide.
  • Whether the petitioner's clean antecedent and period of custody justify granting bail.
