Patna High Court

Kali YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

Kali Yadav was arrested in connection with a violent incident on 19-12-2024 in which he and other accused entered a house, assaulted family members, looted a motorcycle and briefly kidnapped a neighbour. He is charged under IPC Sections 147, 324, 323, 395 and 504. The petitioner sought regular bail, contending that he had already been granted bail for the same occurrence in a related case (Cr. Misc. No. 4163 of 2018) and that a co‑accused had also been bailed (Cr. Misc. No. 10736 of 2025). The State opposed bail, arguing the seriousness of the offences and the existence of a prior FIR. The Court considered the prior bail orders, the length of custody since 01‑08‑2024, and the fact that the charge‑sheet had been filed, and concluded that continued detention was unnecessary. Accordingly, the Court granted bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences under Sections 147, 324, 323, 395 and 504 of the IPC
  • Whether the prior grant of bail in a related case and the bail of a co‑accused affect the present bail application
  • Whether the period of custody and filing of the charge‑sheet justify continued detention
