Patna High Court

Rupesh Kumar @ KanhaiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions.

Summary

The petitioner, Rupesh Kumar, was arrested in connection with a case under Sections 25(1‑B)A and 26 of the Arms Act, with a pistol and cartridges recovered. He had been in custody since 17‑06‑2024 and faced 14 other cases, but claimed innocence and that he was on bail in all other matters. The petitioner applied for bail, arguing false implication, while the State opposed. The High Court considered the facts, the seriousness of the offence, and the petitioner's claim of innocence, and decided to grant bail. He was released on a bail bond of Rs.10,000 with two sureties who must be close relatives, and was directed to attend the police station every Sunday and cooperate with the trial, with non‑compliance leading to cancellation of bail.

Issues considered

  • Whether bail should be granted to the accused in a case under Sections 25(1‑B)A and 26 of the Arms Act despite the seriousness of the offence and multiple pending cases.
