Patna High Court

Manoj Chaudhary @ Manoj SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and conditions under Section 480(3) of the B.N.S.S.

Summary

Manoj Chaudhary was arrested in connection with a case alleging assault on the informant's sister and family members, invoking several serious IPC sections. He sought bail, arguing that the FIR contained vague and omnibus allegations, was filed after a two‑day delay, and that there was no specific charge against him. The State opposed bail, but the court noted the petitioner’s clean antecedent, the submission of the charge sheet, and the prolonged custody. Considering the lack of specificity in the allegations and the petitioner’s circumstances, the court ordered his release on bail with a Rs.10,000 bond and conditions under Section 480(3) of the B.N.S.S. The order also required a close relative as a bailor and attendance at all court dates.

Issues considered

  • Whether the petitioner is entitled to bail despite charges under Sections 147, 149, 323, 325, 307, 447, 504, 506 and 427 of the IPC.
  • Whether the FIR’s vague and omnibus allegations justify denial of bail.
  • Whether the petitioner’s clean antecedent and the period of custody warrant bail.
  • Application of Section 480(3) of the B.N.S.S. in imposing bail conditions.
