DISMISSED

Holding

The application for regular bail was dismissed.

Summary

Navin Kumar was arrested in connection with a case registered on 5 January 2024 for offences under Sections 420, 467, 468, 471, 34 and 120(B) of the Indian Penal Code and Sections 66(B) and 66(D) of the Income Tax Act. He applied for regular bail for the third time after two earlier applications were rejected on 14 March 2024 and 19 March 2025. The petitioner has been in custody since the date of arrest and the trial has progressed to the examination of seven witnesses, with the trial nearing completion. The court considered the seriousness of the charges and the advanced stage of the proceedings. It held that granting bail at this juncture would not be appropriate. Consequently, the bail application was dismissed.

Issues considered

  • Whether regular bail should be granted to the petitioner at this advanced stage of the trial given the nature of the offences and the progress of the case.
