Decided

BAIL GRANTED

Holding

The Court allowed the bail application, granting regular bail to the petitioners.

Summary

The petitioners, Sadan Das and Sonu Kumar, were charged in Punpun Police Station Case No. 63 of 2020 for offences under several sections of the Indian Penal Code, including assault and causing death. They alleged that a quarrel with the informant's father escalated, resulting in injuries that led to his death, and claimed the allegations were general and lacked specific overt acts against them. The petitioners, who have been in custody since 10 October 2025, asserted a clean antecedent and sought regular bail. The State opposed the bail, arguing the seriousness of the charges. The Court, after considering the nature of the allegations, the petitioners' clean record, and the period of custody, allowed the bail application, directing each petitioner to furnish a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioners accused of offences under Sections 447, 341, 323, 325, 307, 379, 504, 506 and 34 of the IPC.
