Patna High Court

Subodh SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Subodh Sah was arrested in August 2025 for alleged possession of 1.10 kg of opium, charged under Section 111 of the Bharatiya Nyaya Sanhita, 2023 and Sections 8, 17(b), 18(b) of the NDPS Act. He contended that the opium was in a bag on a co-accused's motorcycle, that he had no knowledge of its contents, that the quantity was below commercial threshold, and that he has a clean record. The State opposed bail. The Patna High Court, after considering the facts and submissions, granted bail on a bond of Rs.10,000 with two sureties and imposed several conditions, including cooperation with the trial and regular reporting to the local SHO. The court emphasized that bail could be cancelled if the petitioner absents himself from two consecutive hearings, tampers with evidence, or is implicated in similar cases. The application for bail was allowed.

Issues considered

  • Whether bail can be granted in an NDPS case where the alleged quantity of opium is less than commercial quantity and the accused claims lack of knowledge.
  • Whether the charge under Section 111 of the Bharatiya Nyaya Sanhita, 2023, precludes the grant of bail.
  • Whether the circumstances of the case justify the imposition of bail with conditions.
