Patna High Court

RAVI KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to the conditions prescribed under Section 482 of the BNSS and Section 438(2) of the Code of Criminal Procedure.

Summary

Ravi Kumar was arrested in connection with a case registered under sections 126(2), 115(2), 109, 303(2), 324(4) and 3(5) of the Bihar Narcotic Substances Act, 2023 for allegedly assaulting an informant and causing grievous head injury. The petitioner contended that the assault arose out of a land dispute, that he and his mother also sustained injuries, and that a counter‑case had been filed against the informant. The State opposed bail, citing the seriousness of the offences. The High Court, after considering the land‑dispute context and the injuries to the petitioner, allowed the bail application. It ordered that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount, subject to the conditions of Section 482 of the BNSS and Section 438(2) of the CrPC. The order was made for a period of six weeks from the date of the order.
