Patna High Court

Amarjit Kumar @ Amba @ Amarjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted subject to strict conditions.

Summary

Amarjit Kumar, a 21‑year‑old, was arrested in Maheshkhunt for alleged possession of a loaded pistol, cartridges and a mobile phone, charged under Sections 317(2), 317(5), 111 of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1‑Ba), 26 and 35 of the Arms Act. The petitioner claimed that the police had fabricated the recovery and that he was falsely implicated, noting that he had been in custody since 2 August 2025 and had two other pending cases. The State opposed bail, while the petitioner’s counsel argued innocence and lack of actual possession. The court, after considering the submissions, granted bail on a cash bond of Rs 10,000 with two sureties, imposing conditions such as cooperation with the trial, regular attendance before the SHO, and restrictions against tampering with evidence or witnesses. The application for bail was allowed.

Issues considered

  • Whether bail should be granted in a case involving serious offences under the Bharatiya Nyaya Sanhita and the Arms Act.
  • Whether the petitioner poses a risk of tampering with evidence or influencing witnesses.
  • Whether the alleged police recovery of the weapon and accessories is genuine or fabricated.
