Holding
The court granted bail to the petitioner, finding the allegations prima facie general and omnibus and noting the complainant’s alleged propensity to file false cases.
Summary
The petitioner, Saqlain Zeya, was named in an FIR for alleged offences under Sections 341, 323, 379, 509 and 498A of the IPC, accused of mental and physical cruelty over a dowry demand. The petitioner’s counsel argued that the complainant, Nikhat Praween, habitually files false cases and that the allegations are vague and omnibus. The State opposed bail, but the complainant failed to appear despite service of notice. The court noted the prima facie nature of the allegations and the complainant’s alleged habit of filing frivolous cases. Consequently, the court ordered the petitioner’s release on bail with a bond of Rs. 10,000 and two sureties, subject to conditions under Section 482(2) of the Bihar Negotiable Security Act.
Issues considered
- Whether the petitioner is entitled to bail despite the FIR containing charges under multiple IPC sections
- Whether the allegations of mental and physical cruelty are prima facie sufficient to deny bail
- Whether the complainant’s alleged habit of filing false cases warrants a more liberal approach to bail
