The court conditionally granted anticipatory bail, directing the petitioners to surrender within eight weeks and ordering the trial court to take up and preferably dispose of the case on the day of surrender.

Summary

The petitioners, a group of villagers from Sonbarsa, feared arrest in a 2013 case (PS No. 61) involving offences under Sections 147, 149, 332, 333, 337, 338, 353 and 307 of the Indian Penal Code. They argued that they had previously been granted protection under Section 41(A) of the Criminal Procedure Code and now wished to surrender voluntarily and obtain anticipatory bail. The court noted their intention to surrender within eight weeks and directed that the trial be taken up and, if possible, disposed of on the same day of surrender. Accordingly, the court conditionally granted anticipatory bail, subject to the surrender condition. The anticipatory bail application was therefore disposed of by the court.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners who were earlier protected under Section 41(A) of the Cr.P.C. and are now apprehending arrest under the specified IPC sections
