Patna High Court

Rama Nandan Bhagat @ Ram Nandan BhagatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to the conditions imposed.

Summary

The petitioners, Rama Nandan Bhagat and Ramdeo Bhagat, sought anticipatory bail fearing arrest in a case registered under IPC sections 384, 341, 323, 506 and 34, and Arms Act section 27 for an alleged assault on an informant and his family on 17‑08‑2015. The prosecution alleged that the petitioners, along with other accused, were armed and had assaulted the informant, his family and threatened them. The petitioners contended they were innocent, that the allegations were vague and omnibus, and highlighted their clean antecedents. The State opposed the grant of anticipatory bail. Considering the general nature of the accusations and the petitioners' clean record, the court allowed anticipatory bail, directing them to furnish a bail bond of Rs.10,000 each with two sureties, subject to Section 482(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the serious charges under the IPC and Arms Act
  • Whether the allegations in the FIR are sufficiently specific to deny bail
  • Whether the petitioners' clean antecedents justify the grant of anticipatory bail

                                       ORAL ORDER

4 15-01-2026 Heard learned counsel appearing on behalf of the

petitioners and learned APP appearing on behalf of the State.

                                2. The petitioners apprehend their arrest in a case

registered for the offence punishable under Sections 384, 341,

323, 506 and 34 of the Indian Penal Code and Section 27 of the

                   Arms Act.

                                3. The prosecution case, in brief, is that on 17.08.2015

at about 8:30 AM, all the F.I.R. named accused persons,

including these petitioners, variously armed, abused and

assaulted informant and his family members. It is further alleged

that co-accused Umesh Yadav and Nivash Singh threatened the

informant and also misbehaved with daughter of informant.

                       4. It is submitted by learned counsel appearing on

behalf of the petitioners that petitioners are quite innocent and

have committed no offence. From bare perusal of the F.I.R. it is

apparent that these petitioners are only alleged to have assaulted

informant and his family members along with other co-accused

persons. Moreover, allegation of assault is general and omnibus.

          Petitioners claim clean antecedents.

                       5. Learned A.P.P. for the State has vehemently

opposed the prayer for grant of anticipatory bail to the

          petitioners.

                       6. Considering the facts and circumstances of the

case, general and omnibus nature of accusation and clean

antecedents of the petitioners, the prayer for grant of

anticipatory bail to the petitioners is allowed.

                       7. Accordingly, in the event of arrest/surrender within

a period of eight weeks from today, let the above named

petitioners be enlarged on bail on furnishing bail-bond of Rs.

10,000/- (ten thousand) each with two sureties of the like
