Patna High Court

Sujeet Kumar @ Golu ThakurversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to the conditions of Section 480(3) CrPC.

Summary

The petitioner was arrested in connection with a robbery alleged under Section 392 of the Indian Penal Code, where three miscreants allegedly stole cash and valuables from an informant. The petitioner’s name appeared only in the confessional statement of a co-accused who had already been granted bail. No incriminating material was recovered from the petitioner, and he has five prior criminal cases. The petitioner argued that he was falsely implicated and sought bail, while the State opposed the application. Considering the lack of substantive evidence, the filing of the charge‑sheet, and the period of custody, the court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 480(3) of the CrPC.

Issues considered

  • Whether bail should be granted to the petitioner in a case registered under Section 392 IPC.
  • Whether the evidence linking the petitioner to the alleged robbery is sufficient to deny bail.
  • Whether the conditions prescribed under Section 480(3) of the CrPC are satisfied for granting bail.
