Patna High Court

Robin Paswan @ Robin KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Robin Paswan was arrested in connection with a theft, robbery and extortion case (IPC §§ 461, 379, 411) involving the loss of 65‑70 mobile phones, cash of Rs.20,000 and repairing articles worth Rs.15,000 from a shop. The prosecution’s case relied solely on the confessional statement of a co‑accused, Prabhat Kumar, and no material was recovered from the petitioner’s possession or residence. The petitioner, who has no prior criminal record and has been in custody since 25‑Oct‑2025, pleaded innocence and sought bail. The State opposed the bail application. After considering the lack of direct evidence and the petitioner’s clean antecedents, the Court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted when the only evidence against the accused is the confessional statement of a co‑accused.
  • Whether the petitioner’s lack of prior criminal record and absence of material evidence warrant bail under the applicable provisions of the Code of Criminal Procedure.
