The court granted regular bail to the petitioner, directing his release upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

Salamuddin Miyan, a 63‑year‑old petitioner, was arrested in connection with a complaint alleging that he entered the informant’s room, forcibly disrobed her, assaulted her by pressing his neck on hers and injured her with nail marks, and also assaulted the informant’s mother‑in‑law. The petitioner claimed innocence, asserted that he has lived separately from the informant for two years, and highlighted a three‑day delay in filing the FIR as unexplained. He also emphasized his lack of prior criminal record and his prolonged pre‑trial detention since 11‑October‑2025. The State and the informant opposed the bail application, arguing the seriousness of the offences under sections 64 and 62 of the BNS. After hearing both sides, the court considered the circumstances, including the petitioner’s age, health, and the delay in the FIR, and decided to grant regular bail on a bond of Rs.10,000 with two sureties.

Issues considered

  • What is the appropriateness of granting regular bail to the petitioner accused under sections 64 and 62 of the BNS given the nature of the alleged offences?
  • Does the delay in filing the FIR affect the petitioner’s right to bail?
  • Should the petitioner’s age, health, and lack of prior criminal record influence the bail decision?
