BAIL GRANTED

Holding

The court allowed the bail application, granting anticipatory bail to the petitioners subject to the conditions of Section 438(2) CrPC and Section 482 of the BNSS.

Summary

The petitioners, five members of the Ansari family, filed an application fearing arrest in a criminal case (PS No.57 of 2024) where they were charged under several IPC sections for assaulting a victim. The prosecution alleged that the petitioners had assaulted the victim, invoking sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. The petitioners contended that they were falsely implicated and that any injury caused was minor. The learned counsel for the petitioners sought anticipatory bail, invoking Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS. The court, after hearing both sides, found no sufficient ground to deny bail and allowed the application. Consequently, the petitioners were directed to obtain bail by furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of the cited statutes.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail under Section 438(2) CrPC in view of the charges under IPC sections 341, 323, 324, 307, 379, 504 and 506/34.
  • Whether the court can exercise its inherent powers under Section 482 of the BNSS to grant bail in this case.
