Patna High Court

Balaveshwar Kewat @ Baleshwar KevatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner conditionally, as no specific allegation or injury was attributable to him.

Summary

Balaveshwar Kewat sought bail after being named in a FIR for offences under the Bharatiya Nyaya Sanhita, 2023, including assault and theft. The FIR alleged that he and others assaulted an informant and stole jewellery, but the petitioner argued that no specific overt act was attributed to him and that he was implicated only as the father of the main accused, Sujeet Kumar. The State opposed the bail application. The Court examined the lack of a direct allegation against the petitioner and the absence of any injury attributable to him. Considering these facts, the Court ordered that the petitioner be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
