BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, directing release on a bail bond of Rs 10,000 with two sureties.

Summary

Raju Kumar was arrested in connection with a case registered under sections 420, 467, 468 and 471 of the Indian Penal Code for allegedly forging a diploma to obtain a contractual appointment as a survey amin. He has been in custody since 13 August 2025, has no prior criminal record, and a charge‑sheet has already been filed. The petitioner contended that he was falsely implicated and that no forged certificate was submitted by him at the time of appointment. The State opposed the bail application. Considering the nature of the allegations, the five‑month custodial period, the absence of antecedents and the filing of the charge‑sheet, the Court ordered that the petitioner be released on regular bail upon furnishing a bail bond of Rs 10,000 with two sureties of equal amount. The order was pronounced by Justice Partha Sarthy.

Issues considered

  • Whether regular bail should be granted to the accused in a case involving alleged forgery and fraud under IPC sections 420, 467, 468 and 471, considering the nature of the offence, period of custody and absence of prior criminal record.
