Patna High Court

Sugandhi DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Sugandhi Devi was arrested in connection with a murder case (Sections 302/34 IPC) arising from an incident on 14-11-2022 where the victim's husband was allegedly killed after a confrontation at the accused's house. The petitioner contended that she has a clean criminal record and that the FIR contains only a generic allegation against all accused, with no specific act attributed to her. The prosecution opposed bail, while the petitioner highlighted that a similarly situated co-accused, Ramawati Devi, had been granted bail by a coordinate bench. The court noted the absence of a specific charge against the petitioner, her clean antecedent, and the precedent of bail to the co-accused. Consequently, the court ordered her release on bail of Rs.10,000 with two sureties, subject to conditions of cooperation, non‑tampering with evidence or witnesses, and verification of criminal antecedent.

Issues considered

  • Whether bail should be granted to an accused in a murder case under Sections 302 and 34 IPC when the FIR does not specifically allege an overt act by the accused.
  • Whether the clean antecedent of the accused and the grant of bail to a similarly situated co‑accused warrant bail in the present case.
