Decided

BAIL REJECTED

Holding

The court held that the facts and circumstances did not justify the grant of anticipatory bail to the petitioners.

Summary

The petitioners, three relatives of a deceased woman, sought anticipatory bail after an FIR was lodged alleging they participated in the murder of the informant’s daughter following a marriage ceremony. The FIR, registered under Sections 103, 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, named the petitioners along with several unknown persons. The petitioners contended they were innocent, highlighted their clean antecedents, and noted that the father‑in‑law of the deceased was already in custody. The informant and the State opposed bail, emphasizing the short interval between the marriage (26‑04‑2025) and the alleged crime (24‑06‑2025). The court, after hearing counsel, found the circumstances did not warrant the grant of anticipatory bail. Consequently, the petition for anticipatory bail was rejected.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail under the Bharatiya Nyaya Sanhita, 2023 in view of the alleged murder charges.
