The court granted regular bail to the petitioner on condition of a Rs 10,000 bond with two sureties.

Summary

The petitioner, Md. Bablu Alam, sought regular bail in a case registered under Sections 115(2) and 309(4) of the Bihar Penal Code for the alleged theft of a Scorpio car. The prosecution alleged that unknown miscreants, after stopping the informant, stole the vehicle at knife‑point. The petitioner claimed the vehicle was recovered from his possession and that he had purchased it in good faith, having given a confessional statement that he bought an old Scorpio for repair and was unaware it was stolen. He also highlighted that he had been in judicial custody since 11 September 2025 and possessed a prior criminal antecedent. The Additional Prosecutor opposed bail, citing the antecedent, but the court, after considering the facts, ordered the petitioner’s release on bail upon furnishing a Rs 10,000 bond with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner charged under Sections 115(2) and 309(4) of the Bihar Penal Code.
  • Whether the petitioner’s confessional statement and claim of lack of knowledge of the stolen vehicle affect the bail decision.
  • Whether the petitioner’s prior criminal antecedent precludes the grant of bail.
