SANU @ SONU @ SAHIL KUMAR SINGH @ SAHIL KUMARversusTHE STATE OF BIHAR

Decided
Disposal
BAIL REJECTED

Holding

The Court denied pre‑arrest bail to the petitioner.

Summary

The petitioner, Sanu @ Sonu @ Sahil Kumar Singh, was arrested in a case alleging offences under IPC sections 354(c), 354(a), 504, 506, 34 and POCSO Act section 11. The FIR, filed by Tulsi Kumari, claims the petitioner made obscene remarks at a wedding, threatened the victim with forced marriage, and threatened to circulate her photos and videos. The victim’s statement under Section 164 of the CrPC corroborates these allegations. The petitioner pleaded innocence, arguing lack of injury report, absence of a specific assault date, and a clean antecedent, and sought pre‑arrest bail. The State opposed bail, emphasizing the seriousness of the charges and the victim’s recorded statement. The Court, considering the gravity of the accusations and the victim’s statement, rejected the petition for pre‑arrest bail.

Issues considered

  • Whether pre‑arrest bail should be granted to the petitioner given the nature of the alleged offences under the IPC and POCSO Act.
