Decided
Disposal
BAIL REJECTED

Holding

The court refused to grant bail to the petitioner.

Summary

Pappu Singh, accused of offences under Sections 341, 323, 307, 379, 504, 34 and later 302 of the Indian Penal Code, has been in judicial custody since April 20, 2024. The prosecution alleges that he, along with another accused, assaulted the informant's uncle with an iron rod, leading to the victim's death. The petitioner applied for bail, arguing that the trial has not yet concluded despite the prolonged custody. The trial court had not been able to frame charges as the petitioner was absent on the scheduled date. The Patna High Court, after hearing counsel, declined to extend the privilege of bail, citing the seriousness of the charges, especially the murder allegation. The court also directed the trial court to expedite the trial and conclude it within nine months.

Issues considered

  • Whether bail should be granted to an accused facing serious offences including murder when the trial has been delayed.
  • Whether the privilege of bail can be extended in view of the nature of the alleged offences and the length of judicial custody.

                     death took place.
