Patna High Court

Bigu PrasadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that, in view of the petitioner’s clean antecedent and the lack of specific allegations against him, bail is warranted.

Summary

Bigu Prasad was arrested on 4 May 2025 in connection with a dowry‑death case (Sangrampur P.S. Case No. 152 of 2025) under Sections 80 and 3(5) of the Bharatiya Nyay Sanhita, 2023. The prosecution alleged that he, along with co‑accused, was responsible for the death of the victim’s daughter due to non‑payment of dowry. The petitioner contended that he has a clean antecedent, that the FIR contains no specific allegation of assault, overt act or dowry demand against him, and that the charge sheet was filed only after his detention. The learned Additional Public Prosecutor opposed bail. The Court, after considering the lack of specific allegations and the petitioner’s clean record, granted bail on a bond of Rs. 10,000 with two sureties and imposed conditions regarding cooperation, presence in court, non‑tampering with evidence and verification of antecedents.

Issues considered

  • Whether bail should be granted to the accused under Sections 80 and 3(5) of the Bharatiya Nyay Sanhita, 2023 in a dowry‑death case.
  • Whether the absence of specific allegations of assault or dowry demand against the petitioner justifies bail.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence or influencing witnesses.
