Holding

Bail was denied to the petitioner.

Summary

The petitioner, Raja Mehta, was arrested on 12 July 2025 in connection with a POCSO case alleging kidnapping of a minor girl for marriage. He applied for bail, claiming a clean record and that the allegations were false, asserting the victim consented to their relationship and they fled together. The prosecution, represented by the Additional Public Prosecutor and the informant's counsel, opposed bail, relying on the victim's statement under Section 183 of the Bihar Narcotic Substances Act and a medical report indicating an old hymen rupture, confirming the victim's minority (born 16 July 2011). The court examined the seriousness of the offences under Sections 87, 96, 137(2) read with 3(5) of the B.N.S. and Section 8 of the POCSO Act. Considering the evidence and the nature of the charges, the judge refused the bail application.

daughter of the informant for the purpose of marriage.

                      4. Learned counsel for the petitioner submits that

petitioner has clean antecedent and he has falsely been

implicated in the present case. It appears from the F.I.R. that the

Learned counsel has submitted that the petitioner was in love

the victim is a minor at the time of alleged occurrence.

                       6. Considering the aforesaid facts and circumstances

of the case and the statement of the victim recorded under
