Bail is granted to the petitioner subject to conditions under Section 482(2) of the B.N.S.S. 2023.
Summary
The petitioner, Girdhari Kumar, was charged under several sections of the B.N.S., 2023 for allegedly promising to marry a 19‑year‑old woman and engaging in a physical relationship, which the victim later denied under a statement recorded under Section 183 BNSS, stating only a promise of marriage. The petitioner applied for bail, claiming innocence, lack of prior criminal record, and that he had not previously sought anticipatory or regular bail. The State opposed the bail application. The Court examined the victim’s statement, noted the absence of any allegation of physical relationship, and considered the petitioner’s clean record. Consequently, the Court allowed the bail petition, directing the petitioner to surrender within eight weeks and furnish bail bonds of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S. 2023. The order also provided for cancellation of bail if criminal antecedents or false statements were later discovered.
Issues considered
- Whether bail should be granted to the petitioner pending trial for offences under Sections 126(2),115,352,351(2),303(2),69,74 and 3(5) of the B.N.S., 2023.
- Whether the victim’s statement under Section 183 BNSS, which does not allege a physical relationship, affects the bail decision.
