Holding
The Court held that bail could not be granted given the nature of the accusation and the progress of the trial.
Summary
The petitioner, Shambhu Kumar, was arrested on 8 October 2021 in connection with a murder case where he was alleged to be one of the assailants who shot the deceased. He filed a regular bail application which was previously rejected by the trial court on 20 May 2022. The High Court examined the record, noting that eight out of nine charge-sheeted witnesses had already been examined and the trial was progressing. Considering the seriousness of the accusation and the stage of the trial, the Court declined to grant bail. However, the Court directed the trial court to expedite the trial and conclude it within six months of receiving the order. The petition for bail was therefore dismissed.
