Patna High Court

Fantus YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding no prima facie incriminating material against him.

Summary

Fantus Yadav was arrested in connection with a murder case (Sections 302 and 201 IPC) based on a confessional statement of co‑accused Shambhu Sharma, the husband of the deceased. The petitioner was not named in the FIR and no material evidence linking him to the crime was found during the investigation, which has now been completed and a charge‑sheet filed. He has been in custody since 08‑02‑2025 and seeks bail, arguing that the investigation is closed and there is no risk of tampering with evidence. The State opposed the bail, highlighting the petitioner’s involvement in three other criminal matters, two of which he is currently on bail. The Court observed that, apart from the uncorroborated confessional statement, there is no prima facie case against the petitioner and, given the completed investigation, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions under Section 437(3) CrPC and Section 480(3) BNSS.

Issues considered

  • Whether bail should be granted to the petitioner in a murder case where the only link is an uncorroborated confessional statement of a co‑accused.
  • Whether the completion of investigation and filing of charge‑sheet preclude the risk of evidence tampering, justifying bail.
