Anticipatory bail was granted to the petitioner.
Summary
The petitioner, Kumar Arvind Singh, a teacher at Janashakri Degree College, was implicated in an FIR alleging misappropriation of college funds and charged under IPC sections 420, 409 and 120(B). He contended that the alleged withdrawals were his lawful salary and an advance for his daughter's admission, and that the case was fabricated by the complainant to harass him. The petitioner applied for anticipatory bail, arguing that he had no role in the alleged crime and that co‑accused Dr. Sanjay Kumar had already been granted bail. The State opposed the bail application. After considering the material on record, the Court held that the circumstances warranted the grant of anticipatory bail, subject to a bail bond of Rs 10,000 and two sureties, and conditioned on Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order directed that if arrested within eight weeks, the petitioner be released on bail.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the FIR alleging offences under IPC 420, 409 and 120(B).
