Patna High Court

AMIT SINGH @ AMIT KUMAR SINGHversusTHE STATE OF BIHAR

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with a bond and conditions.

Summary

Amit Singh applied for bail in a case registered under multiple sections of the Bihar Narcotic Substances (B.N.S.) Act, 2023 and the Arms Act. The prosecution alleged that Singh coordinated an armed assault, directing a rifle to be given to a co‑accused and recorded on video for a political figure. Singh’s counsel argued that he was not directly involved in any assault, noting that other co‑accused had already been granted bail and that Singh had been in judicial custody since 23‑11‑2025. The State opposed bail, citing Singh’s eight prior criminal cases. After hearing both sides, the court found the bail application credible, imposed a bond of Rs 10,000 with two sureties, and imposed conditions of trial cooperation and weekly police‑station attendance. Consequently, the court granted bail to Singh.

Issues considered

  • Whether bail should be granted to the petitioner despite serious charges under the B.N.S. Act and the Arms Act.
  • Whether the petitioner’s alleged involvement in an armed assault and his criminal antecedents justify denial of bail.
