Patna High Court

Ram Ratan Chaudhary @ Ratan ChaudharyversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The application for regular bail is rejected as there is no ground to review the earlier order.

Summary

The petitioner, Ram Ratan Chaudhary, filed a second application for regular bail in a case registered under Sections 308(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. His earlier bail plea had been rejected on 19‑04‑2025. The court noted that the petitioner is an accused in eleven cases but had disclosed details of only three, indicating a deliberate suppression of material facts. The judge held that such misrepresentation undermines the credibility of the petitioner and provides no basis to revisit the earlier order. Consequently, the court found no ground to grant bail or to review its prior decision. The application for regular bail was therefore rejected.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being an accused in multiple cases.
  • Whether the suppression of material facts by the petitioner justifies denial of bail.
  • Whether the earlier bail order can be reviewed on the basis of new application.

                                       ORAL ORDER

3 18-03-2026 Heard the learned counsel for the petitioner and the

                   learned APP for the State.

                                2. This is the 2nd attempt of the petitioner seeking bail

in connection with Sikandra P.S. Case No. 255 of 2024

registered for the offence under Sections 308(5) and 3(5) of the

                   Bharatiya Nyaya Sanhita, 2023.

                                3. Earlier the bail application of the petitioner was

rejected on 19.04.2025 in Cr. Misc. No. 4084 of 2024. Though

the petitioner is an accused in 11 cases, but only three cases

have been mentioned in the present bail petition. The impugned

order shows that the petitioner is accused in 11 cases, but still

only 3 antecedents have been mentioned.

                                4. In these circumstances, it appears that the petitioner

and the deponent are trying to mislead this Court.
Patna High Court CR. MISC. No.77413 of 2025(3) dt.18-03-2026
                                                        2/2

                                   5. Considering the aforesaid facts and the deliberate

suppression of facts, this Court finds no ground to review its

earlier order. Accordingly, this application for regular bail

                      stands rejected.
