Patna High Court

Neeraj Poddar @ Neeraj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Neeraj Poddar, was arrested in connection with a murder case (PS Simri Bakhtiyarpur Case No. 56 of 2024) alleged under Sections 304(B) and 34 of the Indian Penal Code. The prosecution alleges he killed the deceased, while independent witnesses claim the deceased had an illicit relationship and committed suicide. The petitioner contended that he was falsely implicated and has a clean antecedent. The State opposed bail, but the court, after considering the facts, the petitioner's innocence claim, and his clean record, ordered his release on bail. Bail was granted upon furnishing a bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused in a case punishable under Sections 304(B) and 34 IPC.
  • Whether the allegations of false implication and the claim of suicide affect the bail eligibility.
