Patna High Court

Prince Kumar @ Prince YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that regular bail could not be granted to the petitioner.

Summary

Prince Kumar was arrested in connection with a murder case (Gwalpara P.S. Case No.107 of 2024) alleged under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that he, along with others, killed the deceased over a debt of Rs.70,000 owed to a third party. The petitioner, in custody since 4 March 2025, applied for regular bail. The Patna High Court, noting the seriousness and gravity of the offences, declined to grant regular bail, stating that the petitioner could re‑apply if the trial is delayed. The order was limited to the bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the murder and arms offences
  • Whether the nature of the accusation and gravity of the offence justify denial of bail
