The bail applications were dismissed, affirming the earlier orders denying bail.
Summary
The petitioners, Gagan Raj and Biru Paswan, applied for bail in two separate criminal miscellaneous proceedings arising from a dacoity case (Section 395 IPC) involving robbery of gold and cash, and alleged violations of the Arms Act (Sections 25(1‑b)a, 26 and 34). Both had previously been denied bail by the trial court on 7 March 2025. The prosecution alleged that the accused participated in the dacoity, with Biru Paswan’s self‑inculpatory statement and CCTV footage implicating Gagan Raj. The petitioners’ counsel could not demonstrate any fresh material or change in circumstances warranting a revision of the earlier orders. Considering the seriousness of the offences and the evidentiary material, Justice Sandeep Kumar declined to revisit the prior decisions and dismissed both bail applications.
Issues considered
- Whether bail should be granted to the accused in a dacoity case under Section 395 IPC and related Arms Act offences.
- Whether the presence of a self‑inculpatory statement and CCTV identification constitutes sufficient ground to deny bail.
