Rashid Jamal @ Kamal @ Md. Rashid JamalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no prima‑facie case against him and noting the investigation was already concluded.

Summary

The petitioner, Rashid Jamal, was arrested on 3 March 2025 in connection with a case of supplying counterfeit Indian and Nepali currency, alleged under Sections 179, 180 and 3(5) of the BNS. The FIR alleged that the counterfeit money was found in the possession of a co‑accused, Md. Tahir, and that the petitioner had supplied it. The petitioner’s counsel argued that no incriminating material directly linked him to the crime, that the recovered items belonged to the co‑accused, and that the investigation was complete with a charge‑sheet already filed. The State opposed bail, contending the seriousness of the offence. The court, noting the lack of prima‑facie evidence against the petitioner and the completed investigation, granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions under Section 480(3) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to bail despite allegations of supplying counterfeit currency under Sections 179, 180 and 3(5) of the BNS
  • Whether the completed investigation and lack of prima‑facie evidence justify granting bail
