Holding
The court granted regular bail to the petitioner subject to a bond and sureties.
Summary
The petitioner, Ravikant Kumar, was arrested in connection with a kidnapping and ransom case (Islampur P.S. Case No. 727 of 2024) under Sections 140(2) and 3(5) of the B.N.S. He alleged that he was falsely implicated and that the co‑accused had admitted his role was limited to supplying labourers, with a money dispute being the motive. The petitioner had been in custody since 7 April 2025 and sought regular bail. The State opposed the bail application. After considering the facts, the court held that bail could be granted subject to a bond and sureties. Accordingly, the petitioner was released on bail upon furnishing a Rs. 10,000 bond with two sureties of the same amount.
Issues considered
- Whether the petitioner is entitled to regular bail in a kidnapping‑for‑ransom case under Sections 140(2) and 3(5) of the B.N.S.
- Whether the circumstances of false implication and the co‑accused’s admission justify granting bail
