Aarti Devi @ Arti DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to a bond and sureties.

Summary

Aarti Devi filed a bail application after learning that she might be arrested in connection with PS Lakho Case No. 181 of 2025, which alleged offences under Sections 126(2), 115(2), 118(1), 118(2), 109, 352 and 3(5) of the Bihar Negotiable and Securities Act (BNS). The prosecution alleged that she assaulted the victim, while her counsel contended that she was falsely implicated and the injury was minor. The court examined the allegations and the petitioner's claim of innocence. Finding no compelling reason to deny bail, the court allowed the application. Accordingly, the petitioner was ordered to be released on bail with a bond of Rs. 10,000 and two sureties, subject to the conditions of Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNS.

Issues considered

  • Whether bail should be granted to the petitioner in view of the alleged offences under the BNS.
  • Whether the nature of the alleged assault justifies denial of bail.
