BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

Amar Kumar was arrested on 4 May 2025 in connection with FIR dated 3 May 2025 alleging assault with a bamboo stick that resulted in the death of an informant's nephew. The prosecution charged him under Sections 103(1) and 3(5) of the Bihar Naxal Suppression Act, 2023, but the specific allegation of assault was directed at co‑accused Munna Kumar. The petitioner argued that he has a clean antecedent and was falsely implicated, noting that the FIR does not attribute any overt act to him. The learned Additional Public Prosecutor opposed bail, while the petitioner’s counsel highlighted the lack of specific charges against him. The court, considering the absence of a direct allegation, the petitioner’s clean record, and the circumstances, granted bail on a Rs.10,000 bond with two sureties and imposed standard conditions for cooperation and non‑tampering with evidence.

Issues considered

  • Whether bail should be granted to the petitioner despite charges under Sections 103(1) and 3(5) of the B.N.S., 2023 when no specific allegation of assault is made against him.
