BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

The petitioner, Nitish Kumar, sought anticipatory bail in a case alleging violation of Section 30(a) of the Bihar Prohibition and Excise Act, 2016 for possession of 355.5 litres of illicit liquor recovered from a vehicle. The prosecution alleged that the petitioner fled when police arrived based on secret information and was identified by a local chowkidar. The petitioner contended that he was falsely implicated, not the owner of the vehicle or the seized liquor. The court examined the claim of non‑ownership and the lack of direct evidence linking the petitioner to the contraband. Considering these factors, the court exercised its power under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and granted anticipatory bail subject to a bond and sureties.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bihar Prohibition and Excise Act, 2016.
  • Whether the petitioner’s claim of non‑ownership of the vehicle and liquor negates the likelihood of his involvement.
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, permits the grant of anticipatory bail in these circumstances.
