Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed.

Summary

The petitioners, Mahendra Beldar and Yogendra Kumar, were arrested on 21 September 2025 in connection with a case of alleged molestation of a minor and the viral dissemination of her video, charged under sections of the Bihar Narcotic Substances Act, the POCSO Act and the Information Technology Act. They applied for regular bail, contending innocence, while the State opposed the relief. The court noted that co‑accused had already been granted bail and considered the circumstances of the case. After evaluating the seriousness of the offences and the petitioners’ custody period, the court allowed the bail application. The petitioners were ordered to be released on bail upon furnishing a bond of Rs 10,000 each with two sureties of equal amount.

Issues considered

  • Whether regular bail should be granted to the accused in offences under the Bihar Narcotic Substances Act, the POCSO Act and the Information Technology Act.
  • Whether the prior grant of bail to co‑accused influences the bail decision for the petitioners.
