DISMISSED

Holding

The court dismissed the applications for regular bail, finding no ground to review its earlier orders.

Summary

Petitioners Pankaj Kumar and Sashi Ranjan filed separate applications for regular bail in Criminal Miscellaneous Nos. 76816 and 78815, relating to Bhagwanpur Police Station Case No. 330 of 2024 under Sections 316(2) and 318(4) of the Bihar Negotiable Instruments Act. Their earlier bail applications had been rejected, and they sought a fresh order. The court noted that the main accused, Santosh Kumar, an absconder, had now been arrested and that three witnesses had been examined, underscoring the seriousness of the offences. Considering the gravity of the charges and the recent arrest of the principal accused, the court found no justification to revisit its prior decisions. Consequently, the bail applications were dismissed and the court directed the Principal District and Sessions Judge, Vaishali, to expedite the trial of Santosh Kumar. A copy of the order was to be communicated to the trial court for compliance.

Issues considered

  • Whether regular bail should be granted to the petitioners under Sections 316(2) and 318(4) of the Bihar Negotiable Instruments Act in view of the gravity of the offences and the arrest of the main accused.
