Patna High Court

Sonu Saw @ Sonu Kumar SawversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court dismissed the regular bail application, finding no new ground to grant bail.

Summary

Sonu Saw was charged with kidnapping, ransom demand and several other offences under the Indian Penal Code and the Information Technology Act. He applied for regular bail for the first time, which was denied, and subsequently made a second bail application. The petitioner argued that the trial was progressing, with two witnesses already examined. The court noted the gravity of the offences, the lack of any new ground for relief, and the ongoing trial, and therefore dismissed the bail application. The court also directed the Senior Superintendent of Police, Patna, to ensure the attendance of witnesses in the trial.

Issues considered

  • Whether regular bail can be granted to the petitioner given the seriousness of the offences and the stage of the trial.
  • Whether the petitioner has raised any new ground that warrants revisiting the earlier bail denial.
