Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to the stipulated bond and surety conditions.

Summary

Ashish Kumar was accused of hiring a scholar to impersonate him in the NEET examination, an alleged fraud detected during digital verification. Fearing arrest under multiple IPC offences (120B, 109, 419, 420, 467, 468, 471, 474), he applied for bail, asserting his innocence and cooperation with the investigation. The petitioner relied on the Supreme Court’s decision in Satendra Kumar Antil v. CBI for relief. The Court noted the petitioner’s cooperation, the earlier adjournments granted to CBI, and the precedent, and consequently allowed the bail application. Bail was granted on a bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the BNSS, and the petitioner was directed to appear at each trial date.

Issues considered

  • Whether the petitioner is entitled to bail under Section 438(2) of the CrPC and Section 482 of the BNSS in view of the pending charges under the IPC.
  • Whether the Supreme Court’s judgment in Satendra Kumar Antil v. CBI is applicable to the present bail application.
