BAIL GRANTED

Holding

The court allowed the bail application, granting regular bail to the petitioner.

Summary

The petitioner, Jitan Ram, applied for regular bail in a case registered as Digha P.S. Case No. 344 of 2025, alleging offences under Sections 82(1), 80 and 238 of the B.N.S. The prosecution alleges that the petitioner murdered his daughter over a dowry dispute and disposed of her body at a temple. The petitioner contends he is innocent, claiming the marriage allegation is false, the death was a suicide, no body was recovered from his house, and there is no eyewitness evidence. He also points out the absence of external injuries, preservation of the victim's viscera for forensic analysis, and his clean criminal record. The State opposed bail, but the court, after considering the submissions and circumstances, ordered the petitioner to be released on bail upon furnishing a bail bond of Rs. 10,000 with two sureties, thereby allowing the application.

Issues considered

  • Whether bail should be granted in a case involving alleged murder and dowry‑related offences under Sections 82(1), 80 and 238 of the B.N.S.
  • Whether the petitioner is likely to flee or tamper with evidence
  • Whether the prosecution evidence is sufficient to justify denial of bail
