Patna High Court

Guru Paswan @ Ranjit KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the allegations were serious and the petitioner had a prior criminal record.

Summary

Guru Paswan was arrested in connection with a case (PS Case No 410 of 2025) alleging that he and co‑accused assaulted an informant’s father and family members with weapons such as bricks, lathi and iron rod, resulting in the father’s death due to hemorrhage and shock. The petitioner sought anticipatory bail, contending that the specific charge of a brick assault on the deceased’s head was directed at a co‑accused, and that the allegation against him was merely general. The State opposed the bail, emphasizing the petitioner’s inclusion in the FIR with specific accusations, the fatal outcome of the assault, and the petitioner’s prior criminal record. After hearing both sides, the court considered the seriousness of the offences and the antecedent, and rejected the petition for anticipatory bail. Consequently, the petitioner remains in custody pending trial.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the serious nature of the offences alleged and his prior criminal antecedent.

                                       ORAL ORDER

2 20-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P for the State.

                                2. The petitioner apprehends his arrest in Bahadurpur

P.S. Case No. 410 of 2025, registered for offences under

                   Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109,

103(1) and 352 of the BNS.

                                3. As per F.I.R., allegation against petitioner is that he

along with other co-accused assaulted informant's father with

brick, lathi, danda, iron rod and they also assaulted informant

and his family members. In course of treatment, father of

informant died. During investigation, witnesses have supported

                   the allegation levelled against petitioner.

                                4. Learned counsel for the petitioner submits that

specific accusation of assault by brick on the head of deceased

is against co-accused Rama Paswan. So far as this petitioner is

concerned, there is general and omnibus allegation.
Patna High Court CR. MISC. No.7908 of 2026(2) dt.20-02-2026
                                                       2/2

                                  5. Learned A.P.P. for the State vehemently opposes the

prayer for anticipatory bail and submits that petitioner is named

in the F.I.R. with specific accusation that he along with others

assaulted informant and other family members, on account of

which, during treatment, father of informant died. As per post-

mortem report, deceased died due to hemorrhage & shock from

the injuries, caused by hard & blunt substance. Petitioner has

                     got one criminal antecedent also.

                                  6. Considering the nature of accusation and criminal

antecedent, the prayer for anticipatory bail of petitioner is

                     rejected.
