Holding

The court granted regular bail to the petitioner.

Summary

Kundan Kumar was arrested in connection with a cyber fraud case (Bhojpur Cyber P.S. Case No. 52/2025) alleged under Sections 318(4) and 319(2) of the B.N.S. and Section 66D of the Information Technology Act. He had been in custody since 6 August 2025 and claimed to have a clean antecedent. The informant testified that the entire amount cheated was returned by the petitioner. The petitioner’s counsel argued his innocence and willingness to cooperate with the trial. Considering the return of the cheated amount, the petitioner’s clean record, and the circumstances, the court allowed the regular bail application, directing release on a bail bond of Rs. 10,000 with two sureties.
