Bail was denied to petitioner No. 1 but granted to petitioner No. 2 subject to conditions under section 482(2) of the BNSS, 2023.

Summary

The petitioners, Devanand Kumar and Ramanand Kumar, were named in an FIR for assaulting an informant and his family, with charges under several sections of the Bharatiya Nagarik Suraksha (BNS). They applied for pre‑arrest bail, claiming the allegations against them were general and omnibus and that they have clean antecedents. The State opposed bail, asserting a specific allegation that petitioner No. 1 assaulted the informant with a weapon causing injury. The Court held that the specific allegation against petitioner No. 1 warranted denial of bail, while the general nature of the accusation against petitioner No. 2, coupled with his clean record, justified granting bail subject to conditions. Bail was ordered for petitioner No. 2 under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, with a bond and sureties, and bail was denied to petitioner No. 1.

Issues considered

  • What is the appropriate approach to granting pre‑arrest bail when the charge sheet contains a general or omnibus allegation versus a specific allegation?
  • Whether the clean antecedent of the accused and the nature of the alleged offence justify bail under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
