BAIL REJECTED

Holding

Anticipatory bail was denied as the allegations of grievous assault were substantiated.

Summary

The petitioners, Ranjay Dhanuk and Krishna Dhanuk, sought anticipatory bail fearing arrest in a case (Gidha PS Case No. 168/2025) involving alleged assaults on Ram Bahadur Singh and Jai Bahadur Singh. The prosecution alleged that the petitioners, armed, assaulted the victims and others who intervened, resulting in simple injury to Jai Bahadur Singh and grievous injury to Ram Bahadur Singh. The petitioners contended they were falsely implicated and highlighted the simple nature of one injury. The State argued that the assault on Ram Bahadur Singh was grievous, justifying prosecution. The Court examined the injury reports and found the prosecution’s claim of grievous injury credible, concluding that no relief could be granted. Consequently, the anticipatory bail application was rejected.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners in view of the alleged offences under sections 126(1), 115(2), 117(2), 109(1), 303(2), 352, 3(5), 351(2) of the B.N.S. 2023

                                    4. In this case, the coordinate bench called for the case

diary which is now on record and the injury report shows that

while Jai Bahadur Singh suffered simple injury, Ram Bahadur

                       in nature.

                                    7. In that background, no relief can be extended.

                                    8. The anticipatory bail application stands rejected.
