Patna High Court

Manoj Kumar @ Saroj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a bond and compliance with stipulated conditions.

Summary

Manoj Kumar was arrested on 28‑11‑2024 in connection with a case arising from FIR dated 26‑07‑2024 alleging assault and death of an informant’s son under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, 2023. The petitioner claimed that the FIR was false, he had a clean antecedent and no specific allegation of assault was made against him. The State opposed bail, while the petitioner’s counsel argued that the charges were fabricated. The Court examined the lack of concrete evidence linking the petitioner to the assault and his clean record, and consequently ordered his release on bail with a bond of Rs.10,000 and several conditions. The bail order directed the lower court to verify the petitioner’s antecedent but not to delay the release.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the alleged offences.
  • Whether the FIR and charge‑sheet provide sufficient grounds to deny bail.
  • Whether the petitioner’s clean antecedent and lack of specific allegation against him warrant bail.

                                3. The prosecution story in brief as per FIR is that

on the alleged date of occurrence accused petitioner along

with co-accused took the informant’s son with them. Around

was oozing out from his body and private parts. When the

informant asked him, he told that the petitioner with co-

allegation as alleged in the FIR is false and fabricated and the

petitioner has not committed any offence as alleged in the

and other co-accused persons have assaulted to the son of the

opposed the prayer for bail of the petitioner.
