BAIL GRANTED

Holding

The application for regular bail was allowed.

Summary

The petitioner, Rakesh Mahto, was arrested in connection with a kidnapping case registered as Sarairanjan P.S. Case No. 10/2025, alleged to be punishable under Sections 137(2) and 96 of the B.N.S. The petitioner claimed innocence, asserting that the alleged victim had eloped with him and married him in Delhi, and that he had a clean antecedent. The petitioner applied for regular bail, undertaking to cooperate with the investigation, while the State opposed the bail. The court examined the circumstances, including the petitioner's clean record and the claim of consensual elopement, and found no compelling reason to deny bail. Consequently, the court granted regular bail on the condition of a Rs. 10,000 bond with two sureties of equal amount.

Issues considered

  • Whether the petitioner is entitled to regular bail under Sections 137(2) and 96 of the B.N.S. given the facts of alleged kidnapping and the petitioner's claim of consensual elopement
